She was actually 16 when that movie was made. Although there is an underage rule, it should be noted that My Father The Hero is a kids movie which is often shown in the mornings or afternoon. That particular scene isn't considered explicit or anything. I think the underage rule here is kind of ridiculous in a sense. A thong is an item of clothing, sometimes underwear, sometimes a bathing suit. Where do you draw the line? Are string bikinis too close to a thong? Is a picture breaking the forum rules if someone under 18 is in the background? How can you know for sure that the people shown in the amateur section are over 18?

I think the rule should be largely discretionary with obvious underage nudity being strictly prohibited. I'm sure most of the mods would agree.

If erchdvd's point is true, those rules contradict each other. Whaletail, if considered a porn site, would still be liable to face trouble for showing an underager in any capacity, even in the background, as long as there are other photos of a pornographic nature on the forum.

Though it's only a minor technicality, it might need to be sorted out. This can be done by removing photos which feature this single exception but it might also involve reviewing literally thousands of amateur shots that may feature underagers. Although I don't think Whaletail would targeted by authorities, they do not look kindly on anything bordering underage porn so it's worth asking these questions. Ultimately, Whaletail might have to remove all pornographic imagery in order to drop that conspicuous label of being a "porn site".

There are many websites that show teens in thongs or skimpy clothing but it only becomes criminal when A. clear nudity of an underager is shown (sexual activity of genitalia or B. no nudity of underagers (though there are non-nude underagers on the site) is shown but the site contains other pornographic images.

I do see your point. It's kinda black and white - but life isn't that way. My example was of a none-pornographic scenario. Though taking on-board your point, Whaletail does cross over the line in areas. It's a very fine balance for which is right or wrong.
Best way to sort this issue is not to have under 18s in any capacity in images/video.
I don't make the rules here, nor national laws. I just do the best I can to uphold them were possible:)
